Regulatory Compliance and Import Responsibility
It shall be the sole and exclusive responsibility of the patient to ascertain, verify, and ensure that the importation, possession, and use of homeopathic medicines are permissible under the customs regulations, pharmaceutical laws, and regulatory framework of the patient’s country of residence. The clinic shall not be held liable for any seizure, confiscation, delay, penalty, or legal consequence arising from non-compliance with local laws or import restrictions.
Dispatch and Mode of Shipment
For patients availing online consultation services, medicines shall be dispatched via USPS, Indian Post, or any other postal service as deemed appropriate, particularly in jurisdictions where courier services are unavailable, restricted, or impracticable. The clinic shall not be responsible for delays, loss, damage, misdelivery, or non-delivery caused by postal authorities, customs clearance procedures, force majeure events, or circumstances beyond the clinic’s reasonable control.
Prescription Policy and No Guarantee of Outcomes
Patients may seek clarification regarding the names and dosages of prescribed medicines; however, the clinic is under no obligation to provide detailed explanations, justifications, or theoretical rationale for any prescription. While homeopathy aims to facilitate long-term improvement, no guarantee, warranty, or assurance—express or implied—is made regarding diagnosis, prognosis, cure, or permanent resolution of any disease or medical condition. Therapeutic outcomes are contingent upon multiple variables, including but not limited to patient compliance, lifestyle factors, genetic predisposition, and co-morbidities.
Mode of Communication and Record Maintenance
Patients are strongly encouraged to communicate with the clinic primarily via electronic mail for appointment requests, follow-ups, and treatment-related queries. Such communication facilitates systematic documentation, maintenance of clinical records, and continuity of care. The clinic shall not be responsible for any miscommunication, loss of information, or delay arising from communication through informal or unauthorized channels.
Appointment Scheduling and Telephonic Communication
The clinic reserves the right to contact patients telephonically or through electronic means for the purpose of confirming, rescheduling, or canceling appointments. Failure by the patient to respond to communication attempts may result in forfeiture of the appointment without entitlement to refund or rescheduling.
Limitations of Online Consultation and Duty of Disclosure
The patient expressly acknowledges that online consultation is inherently subject to diagnostic and therapeutic limitations. The clinic’s recommendations are substantially reliant upon the accuracy, completeness, and veracity of the information furnished by the patient. The patient undertakes to provide comprehensive and truthful disclosure regarding present illness, past medical history, ongoing treatments, current medications, allergies, and any other relevant health-related information. The clinic shall not be liable for any adverse outcome arising from incomplete, inaccurate, misleading, or withheld information.
Emergency Situations and Limitation of Liability
The patient expressly acknowledges that the clinic is unable to provide emergency medical care or physical examination in acute or life-threatening situations. In the event of a medical emergency, the patient is obligated to immediately seek assistance from local emergency medical services, hospitals, or licensed medical practitioners. The clinic and attending physician shall bear no responsibility or liability whatsoever for any injury, deterioration, complication, or adverse outcome arising from delayed emergency intervention or reliance on online consultation during emergencies.
Nature of Homeopathic Medicines and Medical Disclaimer
Homeopathic medicines are highly diluted preparations and are generally considered to have a low risk profile when administered under professional guidance. However, individual responses may vary. The clinic does not warrant that the medicines are free from all adverse reactions, intolerance, or idiosyncratic responses. The patient assumes full responsibility for the consumption of prescribed remedies and is advised not to discontinue, modify, or substitute any conventional medical treatment without prior consultation with a qualified allopathic physician.
Non-Substitution of Conventional Medical Care
The services provided by the clinic are not intended to substitute emergency care, surgical intervention, or conventional medical treatment where such treatment is clinically indicated. Patients with chronic, progressive, infectious, psychiatric, or life-threatening conditions are advised to remain under the concurrent supervision of a licensed medical practitioner.
Limitation of Liability and Indemnification
To the maximum extent permitted by applicable law, the clinic, its practitioners, employees, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or in connection with the use of online consultation services, prescribed medicines, or delays in treatment. The patient agrees to indemnify and hold harmless the clinic against any claims, liabilities, losses, damages, costs, or legal expenses arising from misuse of medicines, non-compliance with medical advice, or violation of these Terms and Conditions.
Confidentiality and Data Handling
The clinic shall make reasonable efforts to maintain the confidentiality of patient records and communications; however, the patient acknowledges that electronic communication and data transmission carry inherent security risks. The clinic shall not be held liable for unauthorized access, data breaches, or loss of information resulting from technological vulnerabilities beyond its reasonable control.
Modification of Terms
The clinic reserves the unilateral right to amend, modify, revise, or update these Terms and Conditions at any time without prior notice. Continued use of the clinic’s services shall constitute deemed acceptance of the revised Terms and Conditions.
Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws applicable in the jurisdiction of the clinic’s principal place of business. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the competent courts therein.
